Welcome to Almastack ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our learning management system platform and related services (collectively, the "Service") operated by Almastack Inc.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Acceptance of Terms

By creating an account, accessing, or using Almastack, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a binding legal agreement between you and Almastack Inc.

We may revise these Terms at any time. Your continued use of the Service after any such revisions constitutes your agreement to the revised Terms.

3. Description of Service

Almastack provides a cloud-based learning management system (LMS) platform built on Moodle technology, enhanced with additional features for streamlined site management, user tracking, and billing management for educational institutions and educators.

4. User Accounts and Responsibilities

4.1 Account Creation

To use certain features of our Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5.1 Your Data

You retain ownership of all data, content, and materials you upload, create, or store using our Service ("Your Data"). You grant us a limited license to use Your Data solely to provide and improve our Service.

We offer a 14-day free trial with no credit card required. During the trial period, you have access to all features of the Service with certain usage limitations.

6.2 Paid Subscriptions

After the trial period, continued use of the Service requires a paid subscription. Subscription fees are billed in advance on a monthly or annual basis according to your chosen plan.

6.3 Payment Terms

Payment is due immediately upon subscription or renewal. We accept major credit cards and other payment methods as available. All fees are non-refundable except as required by law.

6.4 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of your current billing period. You will continue to have access to the Service until the end of your paid period.

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Almastack Inc. and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Moodle License

Our Service is built on Moodle, which is licensed under the GNU General Public License (GPL). The Moodle software components remain subject to the GPL license terms.

7.3 User Content

You retain ownership of content you create or upload. By using our Service, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display your content solely for the purpose of providing the Service.

8. Service Availability

We strive to maintain high availability of our Service but cannot guarantee uninterrupted access. We may experience downtime due to maintenance, updates, or circumstances beyond our control.

We will provide reasonable advance notice of scheduled maintenance when possible. We are not liable for any damages resulting from Service interruptions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALMASTACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service will cease immediately.

You may terminate your account at any time by contacting us. Upon termination by either party, we will provide you with a reasonable opportunity to export Your Data, subject to our data retention policies.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of California, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of California.
